Terms of Service

These Terms of Service (“Terms”) govern your use of the Pacific Crest Properties website located at pacificcrestcostarica.com (the “Site”) and any vacation rental reservation made through, or in connection with, the Site or our team. By accessing the Site or submitting a reservation, you agree to be bound by these Terms.
Pacific Crest Properties (“PCP,” “we,” “us,” or “our”) is a property management company operating in Tamarindo, Guanacaste, Costa Rica, currently operating under the personal business name of Roberto Rodriguez Villalobos. References to “you” or “Guest” refer to the individual accessing the Site or entering into a reservation agreement with PCP.

Website Use

Permitted Use

You may use this Site for lawful purposes only. You agree not to:
• Use the Site in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any part of the Site or its underlying systems
• Transmit any unsolicited commercial communications or malicious code
• Reproduce, redistribute, or commercially exploit any content from the Site without prior written consent from PCP

Accuracy of Information

PCP makes reasonable efforts to keep all property descriptions, availability, and pricing information on the Site accurate and current. However, PCP does not warrant that the Site will be error-free or uninterrupted. Property availability and rates are subject to change until a reservation is confirmed in writing by PCP.

Third-Party Links

The Site may contain links to third-party websites, services, or platforms (including Lodgix, WhatsApp, and social media channels). PCP is not responsible for the content, privacy practices, or terms of any third-party service. Access to third-party services is at your own risk.

Vacation Rental Reservations

Reservation Agreement

All vacation rental bookings are subject to a separate Vacation Rental Agreement between you and PCP. The Vacation Rental Agreement governs all terms specific to your stay, including payment, cancellation, security deposit, occupancy, and house rules. These Terms of Service apply to your use of the Site and supplement, but do not replace, the Vacation Rental Agreement.

Reservation Deposits & Payment

A deposit of fifty percent (50%) of the total rental amount is required at the time of booking to confirm your reservation. The remaining balance is due sixty (60) days prior to your Check-In Date. Reservations made within sixty (60) days of the Check-In Date require payment in full at the time of booking.
All amounts are quoted and payable in United States Dollars (USD). PCP accepts payment by credit card via Stripe and bank wire transfer. Credit card transactions are processed securely through Stripe. Any bank transfer fees or currency conversion costs are the sole responsibility of the Guest.

Security Deposit

A security deposit is required for all reservations and is due on your Check-In Date. Security deposit amounts typically range from USD $500 to USD $2,000 depending on the property. The security deposit will be released or refunded within fourteen (14) days of check-out, provided the Property is returned in the same condition as at check-in, no house rules have been violated, and no items are missing or damaged.

Identity Verification

To protect all parties and comply with payment processing requirements, PCP may require identity verification prior to confirming a reservation or processing payment. This may include submission of a government-issued photo ID and a selfie matching the cardholder. Verification requirements are managed in accordance with PCP’s Privacy Policy.

Check-In & Check-Out

Standard check-in time is 3:00 PM. Standard check-out time is 10:00 AM. Early check-in and late check-out are subject to availability and must be confirmed in writing by PCP prior to arrival. Unauthorized late check-out will result in a fee equivalent to one (1) full night’s nightly rate.

Cancellation Policy

Standard Cancellations

Cancellations made 31 days or more prior to the Check-In Date: Guest will receive a refund of eighty percent (80%) of the total amount paid at the time of cancellation.
Cancellations made 30 days or fewer prior to the Check-In Date: Non-refundable. No refund will be issued unless PCP is able to re-rent the Property for the same dates at the same rate, in which case Guest will receive a refund of the re-rented amount minus any applicable transaction fees.

Holiday Periods

All Holiday Period reservations are strictly non-refundable regardless of cancellation date. Holiday Periods are defined as:
• Easter Week 2026: March 29 – April 5, 2026
• Easter Week 2027: March 21 – March 27, 2027
• Thanksgiving 2026: November 23 – November 30, 2026
• Thanksgiving 2027: November 23 – November 30, 2027
• Christmas & New Year: December 19, 2026 – January 3, 2027 (7-night minimum)

If arrival or departure dates fall partially within a Holiday Period, Holiday Period terms apply to the entire reservation.

Force Majeure

Cancellations caused directly by acts of God, natural disasters, government-mandated travel restrictions, pandemics, or other events beyond the reasonable control of either party are fully refundable. Written notice and supporting documentation must be provided to PCP within 48 hours of the triggering event.

Cancellation by PCP

PCP reserves the right to cancel a reservation due to property unavailability caused by circumstances beyond its control. In such cases, Guest will receive a full refund of all amounts paid. PCP’s liability is limited solely to the refund of amounts paid and does not extend to consequential damages, travel costs, or other losses.

House Rules

Occupancy

The Property may not be occupied by more guests than the maximum occupancy specified in the Vacation Rental Agreement. All guests must be registered at the time of booking. Children under two (2) years of age are not counted toward the guest total. Unauthorized over-occupancy will result in a penalty of USD $1,000 per occurrence and may result in immediate termination of the reservation without refund.

No Smoking

All PCP properties are strictly non-smoking. Smoking of any substance inside the Property, including covered terraces and enclosed outdoor areas, is prohibited. Evidence of smoking inside the Property will result in a minimum damage assessment of USD $500.

No Pets

Pets of any kind are strictly prohibited at all PCP properties unless explicitly authorized in writing by PCP prior to check-in. Unauthorized presence of a pet will result in immediate forfeiture of the full Security Deposit and may result in termination of the reservation without refund.

Noise & Quiet Hours

Quiet hours are from 10:00 PM to 8:00 AM. All music, amplified sound, and outdoor gatherings must cease during quiet hours. Complaints from neighbors or community administration may result in an immediate warning, Security Deposit deduction, or termination of the reservation.

Events & Parties

Organized events, parties, or gatherings beyond the registered guest count are strictly prohibited without prior written authorization from PCP. Unauthorized events constitute a material breach of the Vacation Rental Agreement and may result in immediate termination of the stay without refund.

Property Care

Guest is responsible for the reasonable care and cleanliness of the Property during the rental period. Guest agrees to dispose of trash properly, report any damage or malfunction to PCP immediately, and lock all doors and windows when leaving the Property.

Energy Conservation

PCP is an ecologically minded business. Guests are asked to turn off air conditioning units and lights when not in use and to conserve water throughout their stay.

Liability & Disclaimers

Guest acknowledges that use of the Property and its amenities carries inherent risks. PCP, its authorized representatives, and the property owner shall not be liable for any personal injury, illness, death, or loss or damage to personal property sustained by Guest or any registered occupant during the rental period.
PCP’s total liability to Guest under any circumstances shall not exceed the total rental amount paid by Guest for the reservation giving rise to the claim. PCP is not liable for consequential, incidental, or punitive damages.
PCP does not warrant that the Property will be free of mechanical failures, utility interruptions, insect or wildlife encounters, or similar occurrences common in tropical residential environments. PCP will make commercially reasonable efforts to resolve reported issues promptly.

Intellectual Property

All content on this Site, including text, photography, logos, and design, is the property of Pacific Crest Properties or its respective licensors and is protected under applicable copyright law. You may not reproduce, distribute, or use any Site content for commercial purposes without the prior written consent of PCP.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Costa Rica, including Ley 8968 on personal data protection. In the event of a dispute, both parties agree to attempt resolution through good-faith mediation before initiating legal proceedings. If mediation fails, disputes shall be submitted to the competent courts of San José, Costa Rica, which shall have exclusive jurisdiction.

Changes to These Terms

PCP reserves the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Site following the posting of updated Terms constitutes acceptance of those changes.
